Brian Grimm joined the firm in August 2010. Prior to joining Bennett Bigelow & Leedom, P.S., Brian was a partner in the Trial Group at Dorsey & Whitney LLP. Brian represents clients in a diverse range of disputes in the federal and state courts of Washington and throughout the U.S., as well as before administrative agencies and arbitration panels. Brian also has particularly substantial experience representing healthcare providers in disputed matters arising under Washington’s certificate of need laws, including in adjudicative proceedings before the Washington Department of Health, judicial review proceedings in superior court, and in appeals to the Washington Court of Appeals and the Washington Supreme Court.

Andrew (Andy) Sachs joined the firm in May 2010. Prior to joining Bennett Bigelow & Leedom, P.S., Andy was an associate with Davis Wright Tremaine LLP. Andy has significant trial and courtroom experience, both in state and federal court. Andy received his J.D. from the University of Chicago Law School.
Kelly Thomas rejoined the firm in February 2010. Kelly's practice focuses on health care regulatory, reimbursement, and fraud and abuse issues. She represents health care providers nationwide in administrative appeals and litigation involving the Medicare and Medicaid programs. Kelly has also assisted health care providers and suppliers, including hospitals and health systems, academic medical centers, physicians, and imaging centers with internal investigations of allegations of fraud or other noncompliance with state or federal health care laws.

Dan Keefe joined the firm in November 2009. Prior to joining Bennett Bigelow & Leedom, P.S., Dan was with Helsell Fetterman for three years. He was with Reed McClure for three years, first as a senior associate then as a shareholder. He also spent more than five years as an associate attorney with Bullivant Houser Bailey in Seattle, after practicing two years in Spokane. While at these firms, his work focused on insurance defense litigation ranging from auto, product and premises liability to asbestos defense, pharmaceutical work, toxic tort and multidistrict litigation. Dan received his J.D. from Gonzaga University School of Law.
The Washington State Supreme Court issued its decision in Ambach v. French, holding that a medical malpractice plaintiff cannot obtain relief under the Consumer Protection Act ("CPA") by alleging that the doctor performed surgery instead of non-surgical treatment for business reasons. The court stated that payment for medical treatment "does not transform medical expenses into business or property harm" that can support a CPA claim--the monetary injury "cannot be separated from the personal injury" at issue in the medical malpractice claim. Bennett Bigelow & Leedom has filed an action against the State on the behalf of the Washington State Pharmacy Association and others to prevent implementation of drastic cuts in reimbursement for certain drugs dispensed to Medicaid patients. The lawsuit asserts that the State's action violates federal law, which requires the State to assure that Medicaid patients have access to services of like quality to those generally available in the community, because the cuts will force some pharmacies to drop out of the Medicaid program and will force others to stop dispensing life-saving drugs, such as those commonly prescribed for AIDS patients. On March 31, 2009, U.S. District Judge Robert Bryan granted a temporary restraining order against the State, enjoining implementation of the cuts until a more extensive hearing on the lawsuit.
