BB&L Attorney Mike Madden Argues Seattle School District Case

On June 28, 2007, the Supreme Court of the United States issued its decision in the Seattle and Louisville student assignment cases, which dealt with the authority of public schools to consider race to assign students for purposes of achieving diversity in individual schools. By a 5-4 vote, the Court determined that both the Seattle and Louisville plans were invalid because the school districts had not adequately demonstrated that their goals could not be achieved through other means. Justice Kennedy joined the plurality opinion, written by Chief Justice Roberts, but on narrow grounds specific to the plans and the record in the particular cases. Five justices (including Justice Kennedy) agreed, however, that achieving diverse, integrated schools is sufficiently important to warrant the consideration of race under certain circumstances. Rejecting the views of the Chief Justice, Justice Kennedy wrote:

This Nation has a moral and ethical obligation to fulfill its historic commitment to creating an integrated society that ensures equal opportunity for all of its children. A compelling interest exists in avoiding racial isolation, an interest that a school district, in its discretion and expertise, may choose to pursue. Likewise, a district may consider it a compelling interest to achieve a diverse student population. Race may be one component of that diversity, but other demographic factors, plus special talents and needs, should also be considered.
